Juul Labs files complaint with ITC against copycat products

Juul Labs announced that it has filed a complaint with the United States International Trade Commission alleging that multiple entities infringe the claims of several of Juul Labs' patents, and requesting the ITC prevent the continued importation, distribution, selling, and marketing of the identified products in the United States. The ITC action is part of Juul Labs' global efforts to defend the company's intellectual property from infringers, and also serves an important role in the company's effort to combat illegal underage use of Electronic Nicotine Delivery System products. The ITC complaint alleges that over 15 entities, based in China, the United States, and France, blatantly develop and sell products based on Juul Labs' patented technology. Juul Labs has begun a similar action in the United Kingdom. As indicated in the ITC Complaint, whereas Juul Labs implements strict manufacturing and quality controls during the manufacturing of its products, little is known about how most of the accused devices are manufactured. Similarly, whereas Juul Labs applies strict age-gating when selling its products through its website, many of the accused products appear to be sold with little or no real age-verification processes. Notably, in contrast to Juul's products, many of the accused copy-cat products include inappropriate flavors, seemingly directed to attract underage users - flavors like "Bubble Bubble," "Apple Juice" and "Sour Gummy." The ITC complaint follows Juul Labs' August trademark filing against 30 counterfeiters who were selling counterfeit products through the internet with no age verification. In addition, since 2018, Juul has worked to remove more than 17,000 improper listings from online marketplaces, including eBay (EBAY) and Amazon (AMZN). Publicly traded companies in the tobacco space include Altria Group (MO), British American Tobacco (BTI) and Philip Morris (PM).

Tobacco stocks to rally on PM USA price increase, says Wells Fargo
Wells Fargo analyst Bonnie Herzog says Altria Group (MO) and Philip Morris (PM) just announced a "healthy and slightly higher than expected" wholesale list price increase on all of its cigarette brands, including Marlboro The analyst learned from industry contacts that PM USA took a cigarette list price increase of 10c per pack or $1.00 per carton on Marlboro, L&M, and B&H Menthol, 15c per pack on Parliament and Virginia Slims, and 50c per pack on everything else. The 10c per pack increase on Marlboro is slightly higher than the 9c per pack increase Altria took on Marlboro in March 2018, reflecting the company's "significant pricing power," Herzog tells investors in a research note. The analyst expects British American Tobacco (BTI), Reynolds and ITG Brands will follow Altria's lead and increase prices in the next few days, but possibly not as robust of an increase. She expects Tobacco stocks will react favorably to this list price increase and reiterates an Overweight rating on the sector and Outperform rating on Altria Group.Fargo

Morgan Stanley says FDA e-cig stance positive for Altria, British American
After the FDA announced a plan to address growing concerns about youth e-cigarette use, Morgan Stanley analyst Pamela Kaufman called the FDA's "harsh stance against the e-cig category" a positive development for U.S. tobacco names Altria (MO) and British American Tobacco (BTI). The threat of a potential expedited PMTA submission deadline and the removal of flavors could have significant negative implications for JUUL and would minimize its threat to combustible cigarettes, said Kaufman. The FDA's potential actions would also hurt tobacco companies' e-cig initiatives, but they are "well-equipped" and experienced in managing through heightened regulatory scrutiny, added the analyst, who believes that overall the FDA is "sending mixed messages" on its nicotine reduction agenda.

Jefferies analyst Owen Bennett downgraded both Philip Morris (PM) and Altria Group (MO) to Hold from Buy. The analyst lowered his lowered his price target on the former to $80 from $93 and on the latter to $61 from $70. For Philip Morris, the analyst sees significant share loss in Japan heated in the second half of 2018 and believes its longer-term total tobacco volumes will pressured due to greater skew to vapor. For Altria Group, Bennett believes market share pressures should pick up again the second half of 2018. Further, he sees the company at a disadvantage in vapor due to available formats and believes concerns around the delay of an IQOS approval will likely weigh on the shares. The analyst reiterates a Buy rating on shares of British American Tobacco (BTI).

Piper Jaffray analyst Michael Lavery says Philip Morris updated its 2018 guidance for currency and gave medium-term guidance, with a medium-term objective of 5% or better organic sales growth and 8% or better earnings growth. The analyst considers these targets "to be realistic and achievable, and likely even beatable." The company also announced implementation of zero-based budgeting, which is expected to drive $1B of annualized cost savings by 2021, Lavery tells investors in a research note. Further, Philip Morris revised guidance for currency to reflect a 12c hit and now expects earnings per share in a range of $4.97-$5.02, down from $5.02-$5.12, the analyst points out. Lavery keeps an Overweight rating on the shares with a $99 price target.

MORGAN STANLEY RAISES ALPHABET, AMAZON TARGETS: Morgan Stanley analyst Brian Nowak raised his price target on shares of Alphabet (GOOGL) to $1,515 from $1,325 citing the continued strong fundamentals in its core Google business as well as the growing visibility into its Waymo business. Nowak, who raised his 2018 and 2019 adjusted EBITDA estimates by 2%, kept an Overweight rating on Alphabet shares. Additionally, Nowak expressed increasing confidence that Amazon's (AMZN) rapidly growing, high margin revenue streams will drive higher profitability and continue to push up consensus estimates. He has not made any changes to his estimates, but raised his price target on Amazon shares to $2,500 from $1,850 to reflect its improving business mix and his belief that the new target more accurately represents the company's long-term potential earnings power. He maintained an Overweight rating on Amazon shares. FERRARI UPGRADED TO BUY: HSBC analyst Giulio Pescatore upgraded Ferrari (RACE) to Buy and raised his price target for the shares to EUR 133 from EUR 114. ROYAL CARIBBEAN UPGRADED TO BUY: Deutsche Bank analyst Chris Woronka upgraded Royal Caribbean Cruises (RCL) to Buy and raised his price target for the shares to $146 from $135. Further, he sees the potential for more inflows into cruise stocks for the balance of 2018 as comps get tougher across sectors like lodging, retail, and Macau, but "relatively easier" for Royal Caribbean. JEFFERIES RAISES TARGET ON PAYPAL: Jefferies analyst John Hecht raised his price target for PayPal (PYPL) to $110 from $100 saying the company's growth story is more than just Venmo. While Venmo is an important growth driver, PayPal's core person-to-person business and mobile trends, which have been "impressive," should be followed more closely alongside the Venmo success, Hecht said. The analyst's updated analysis supports his belief that the eBay (EBAY) migration should be "very manageable" for PayPal. After performing a deep-dive analysis of online retailers' opportunity in online advertising, Wells Fargo analyst Peter Stabler concludes that the effort remains in early days, with untapped ad demand among CPG advertisers, potential tailwinds from increasing ad coverage and improved ad targeting, an emerging opportunity among non-endemic advertiser categories, and ongoing development of online retailers' ad technology and supporting partner ecosystems. The analyst estimates that Amazon's (AMZN) pureplay retail ad business will generate nearly $7B of revenue this year, with other display and video ads to generate about $2B in gross revenue. Stabler argues that Amazon is well ahead of the online retail pack in terms of audience scale and engagement, ad platform development, and sales/partner execution, but is also still in the early days of penetrating its opportunity across retail. Additionally, the analyst believes eBay (EBAY) is also well positioned but may face more limited opportunity.

Trade Desk pullback due to misplaced concerns about Amazon, says Stifel
Stifel analyst John Egbert raised his mid- and long-term estimates for Trade Desk (TTD) citing momentum from new advertiser wins and the fact that platform spend and attach rates are benefiting from the recent New Wave product launch. Amazon will need to address productivity after wage increase, says Bernstein
Bernstein analyst Brandon Fletcher notes that Amazon has announced a company-wide minimum wage increase to $15/hour effective at the beginning of November. Though most retailers announced some variation of store employee wage increase or alternative benefit over the past few years, this jump in wages goes beyond any other retailers' immediate plans, he points out. On the one hand, the analyst believes this is an interesting move to attract and retain talent, reduce turnover, and incentivize better service levels while managing public perception. On the other, in traditional brick and mortar retail, these types of wage increases need to go hand in hand with productivity improvements, and Amazon will need to address productivity if they want Whole Foods to continue being a profitable segment of their business, he contends.
