Stifel analyst Christopher Growe notes that House Democrats have reportedly put forth a bill to raise nicotine and tobacco taxes by roughly $100B over 10 years, which he said is "roughly in line" with the proposals put forth by Senator Richard Durbin that call for a doubling of the federal excise tax on cigarettes and more significant increases on oral and vaping products. Growe thinks Altria (MO) could trade down on this news due to the headline risk around tax increases, but adds that he expects "a lot of horse-trading leading up to any eventual increase in excise taxes." Other publicly traded companies in the tobacco products space include British American Tobacco (BTI), Imperial Brands (IMBBY) and Philip Morris (PM).

Barclays analyst Gaurav Jain downgraded Vector Group (VGR) to Underweight from Equal Weight with a price target of $13, down from $15. The analyst believes British American Tobacco (BTI) has "stepped up its pricing aggression" in the discount segment of the U.S. cigarette market through the repositioning of Lucky Strike. BAT and Altria (MO) have historically not participated in the discount segment, which has enabled Vector to be a share gainer, says the analyst. "That dynamic has now changed," contends Jain.

Acting FDA Commissioner Janet Woodcock, M.D., and Mitch Zeller, J.D., director of the FDA's Center for Tobacco Products, issued a statement, which reads in part: "On this day last year, the U.S. Food and Drug Administration faced the unprecedented task of reviewing applications for over 6.5 million "deemed" new tobacco products - many of which were already on the market. A majority of the applications submitted by a court-ordered deadline of Sept. 9, 2020, were for electronic nicotine delivery systems products, such as e-cigarettes and e-liquids, which had never been through the FDA review process. We've made significant progress in the months since, working diligently to better understand these products and, as of today, taking action on about 93% of the total timely-submitted applications. This includes issuing Marketing Denial Orders for more than 946,000 flavored ENDS products because their applications lacked sufficient evidence that they have a benefit to adult smokers sufficient to overcome the public health threat posed by the well-documented, alarming levels of youth use of such products... However, there's more work to be done to complete our remaining reviews and ensure that we continue taking appropriate action to protect our nation's youth from the dangers of all tobacco products, including e-cigarettes, which remain the most commonly used tobacco product by youth in the United States. As required by statute, a key consideration in our review of premarket tobacco product applications submitted for products like e-cigarettes is to determine whether permitting the marketing of the product would be 'appropriate for the protection of the public health,' taking into account the risks and benefits to the population as a whole. This determination includes consideration of how the products may impact youth use of tobacco products and the potential for the products to completely move adult smokers away from use of combustible cigarettes. Importantly, we know that flavored tobacco products are very appealing to young people. Therefore, assessing the impact of potential or actual youth use is a critical factor in our determination as to whether the statutory standard for marketing is met. As of today, the agency has taken action on applications for over 6 million ENDS products, including refusing to file one company's applications for approximately 4.5 million products because required contents were missing as well as issuing 132 MDOs for more than 946,000 flavored ENDS products, including flavors such as Apple Crumble, Dr. Cola and Cinnamon Toast Cereal. We continue to work expeditiously on the remaining applications that were submitted by the court's Sept. 9, 2020, deadline, many of which are in the final stages of review. For premarket tobacco product applications, our responsibility is to assess whether applicants meet the applicable statutory standard for marketing their new products. As we have said before, the burden is on the applicant to provide evidence to demonstrate that permitting the marketing of their product meets the applicable statutory standard. Our continued review also includes a smaller number of pending applications that are being reviewed under the 'substantial equivalence' standard, for cigars, pipes and hookah tobacco and for which we've granted marketing orders covering over 350 products." The FDA, which faces a court-mandated deadline on Thursday to respond to applications from Juul and other e-cigarette makers who had to submit their products for review to keep them on the U.S. market, is expected to seek more time before deciding on the issue, reported The Wall Street Journal's Jennifer Maloney, citing people familiar with the matter. The U.S. Supreme Court rejected a challenge to the Food and Drug Administration's regulation of electronic cigarettes and vape pens. The appeal by Mississippi's Big Time Vapes and an industry trade group sought to invoke the non-delegation doctrine, a "sparingly used constitutional rule that says Congress must give clear guidance to an agency before handing off its legislative responsibilities," according to Bloomberg. The Supreme Court said: "The motion of 19 National and State Electronic Nicotine Delivery System Product Advocacy Associations for leave to file a brief as amici curiae is granted. The petition for a writ of certiorari is denied." Publicly traded companies in the tobacco space include Altria Group (MO), British American Tobacco (BTI), Imperial Brands (IMBBY) and Philip Morris (PM).

Texas Attorney General Ken Paxton announced a settlement agreement with tobacco companies that will result in $195M paid to Texas. "The lawsuit arose out of the 1998 Texas Tobacco Settlement Agreement, by which major tobacco companies must make annual payments to Texas to reimburse it for smoking-related health care costs. In 2015, ITG Brands LLC acquired four cigarette brands from R.J. Reynolds Tobacco Company-Kool, Maverick, Salem, and Winston-but neither company made the required settlement payments related to those brands after the sale. Because of the agreement, ITG Brands has assumed the financial obligations for these brands, agreed to pay $195 million now in back payments owed, and committed to make payments to the State of Texas going forward," Paxton announced.
